Terms and Conditions

Welcome to Fern Grotto Inn! (FGI) In an effort to make everyone’s stay as pleasant as possible, we have adopted these Terms and Conditions which shall apply to all Guests. By making a reservation with us, you agree to the following Terms and Conditions:

Security Deposit and Rental Payment: A $500 Security Deposit will be required to book your reservation for the Ohana House, $200 for the other cottages (River, Canal & Garden) and $2,500 for all of the Units (“Compound Rental”). The Security Deposit will be refunded 10 days after departure less damage/replacement costs, if any. You agree to this by booking a Unit. The balance of Rent and other fees are due 60 days before your check-in date. Failure to pay this balance by that time will result in forfeiture of the Security Deposit. If you are booking this within 60 days of your check-in date, the total amount of Security Deposit and Rent is due at time of booking.

Cancellation Policy: Cancellations will forfeit the full Security Deposit and Rent, unless we are able to rebook the Unit, then we will refund your Security Deposit and Rent minus a $50 processing fee. Any changes to reservations, i.e., booking another Unit or another date that is within six months (180 days) of the initial check-in date, that are made more than 60 days prior to the check-in date will not result in a forfeiture of the Security Deposit or Rent. Cancellations and early departures due to inclement weather do not warrant any refund.

Credit Card Authorization: I understand and consent to the use of the credit card provided without my original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the premises are vacated. Charges may include, but not be limited to, damages beyond normal wear and tear.

Severe Weather: As we all know, the weather here is tropical but can be uncertain. We therefore do not refund Rents or Security Deposits due to canceled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of Rent or Security Deposit.

Cleaning: Rental Rates include a one-time linen setup and cleaning service at the time of departure. Guests will need to provide their own paper items and cleaning supplies. An initial set up of toiletries is provided. Extra items needed are the responsibility of the Guest.

Check-Out Procedures: We know you are on vacation and we do appreciate your business. But we do have to ask that you abide by our Check-Out Procedures. The main reason for this is so we can get the Unit ready for the next guests, who often arrive only hours after you leave. We accommodate late check out & early check in if available. Please check with us. If you leave the Unit in great shape, the next family can have access to the Unit on time. We really appreciate you following these procedures:

1. Check-out time is by 11:00 am.
2. Please clean all dishes.
3. Gather all your laundry in a pile.
4. Take all of the trash in the unit to the bins outside, by the parking lot entrance.
5. Leave the keys inside the unit & lock the door behind you.

Please leave the Unit neat and orderly to avoid additional charges. If the cleaning crew finds that the Unit has been left excessively dirty you will be billed for the additional cleaning time. If the cleaning company detects any evidence of smoking in the units you will be billed an additional $200 to deodorize the home. Please leave the house in as good as shape as possible. The cleaner we find it, the faster we can turn it over to the next guest. We appreciate your help.

Guest agrees that all guests and invitees will observe all Terms and Conditions of this Agreement so as to maintaining the Premises in good order and appearance, and that all will conduct themselves in a manner inoffensive to neighbors.

Guest agrees that any guest or invitee who violates any of the Terms and Conditions of this Agreement may be immediately denied access to the Premises and any Unit in the sole discretion of FGI.

Guest agrees that any guest or invitee using drugs or allows others to use drugs on the Premises will be subject to immediate removal from the Premises, by force if necessary, and denied any further access to a Unit or the Premises in the sole discretion of FGI.

Guest and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the Premises for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the Premises or the Unit.

Guest agrees that denial of access to the Premises or Unit by FGI for any purpose described herein or other violation of the Terms and Conditions of this Agreement in the sole discretion of FGI shall not warrant any refund of Rent or Security Deposit.

Guest agrees that you are responsible for any and all damages that occur to the Units, Premises or any contents caused by you or any other member of your group, individually or collectively, while you are the registered occupant of a Unit. Any damage noticed upon arrival should be reported to FGI immediately. All general maintenance should also be reported so the Unit can be kept in good repair.

Guest agrees that you are liable for any damages to the Unit or Premises and/or for any injuries to persons caused by the conduct or actions of Guest and your guests and/or invitees. You further agree that FGI shall not be liable to Guest, your guests and/or invitees for any such damages and that Guest agrees to indemnify and hold FGI harmless from any and all claims, action, demands, liability or causes of action (including reasonable and necessary attorneys’ fees incurred by FGI for defense against any such matter) that FGI may incur or be liable for arising out of Guest’s occupation of a Unit or the Premises.

In the event that any action shall be commenced by either party arising out of, or concerning this Agreement or any right or obligation derived therefrom, the prevailing party shall be entitled to recover reasonable and necessary attorney's fees as fixed by the Court in addition to all relief at law or equity.

The Policies and Procedures above are meant to protect our Guests and owners alike. All Guests are required to conform to and comply with all Policies and Procedures.



Damages: You are responsible for any and all damages that occur to the Unit or Premises or their contents by you or any other member of your group while you are the registered occupant of the Unit.
